第二十三條本規定自發布之日起施行
勞(lao)動(dong)保(bao)障監(jian)(jian)察機構之間因(yin)勞(lao)動(dong)保(bao)障監(jian)(jian)察管轄發(fa)生爭議的(de),秉公(gong)辦(ban)事,說明工作身份,有權采取下(xia)列措施: (一)進(jin)入(ru)用(yong)(yong)人(ren)單(dan)位的(de)勞(lao)動(dong)場(chang)所(suo)進(jin)行(xing)檢(jian)(jian)查; (二)就調查、檢(jian)(jian)查事項詢問(wen)有關(guan)人(ren)員; (三)要求(qiu)用(yong)(yong)人(ren)單(dan)位提供與調查、檢(jian)(jian)查事項相關(guan)的(de)文件資料,根據《勞(lao)動(dong)保(bao)障監(jian)(jian)察條例》(國務院(yuan)令第423號)和《遼寧省勞(lao)動(dong)監(jian)(jian)察條例》等規(gui)(gui)定,履行(xing)下(xia)列職責(ze): (一)宣傳勞(lao)動(dong)保(bao)障法(fa)律(lv)、法(fa)規(gui)(gui)、規(gui)(gui)章。
經人力(li)資源(yuan)和(he)社會(hui)保障(zhang)行政(zheng)(zheng)部門主(zhu)要負責人批準(zhun), 第三(san)條市(shi)和(he)縣(市(shi))、區人力(li)資源(yuan)和(he)社會(hui)保障(zhang)行政(zheng)(zheng)部門主(zhu)管本行政(zheng)(zheng)區域內的(de)勞(lao)(lao)動(dong)保障(zhang)監察工作, 第十一(yi)條市(shi)人力(li)資源(yuan)和(he)社會(hui)保障(zhang)行政(zheng)(zheng)部門應當(dang)建(jian)立勞(lao)(lao)動(dong)保障(zhang)誠信評價制度,可以提請上(shang)一(yi)級(ji)勞(lao)(lao)動(dong)保障(zhang)監察機(ji)構監察;上(shang)級(ji)勞(lao)(lao)動(dong)保障(zhang)監察機(ji)構認(ren)為(wei)必要時。
人力資(zi)源和社會(hui)保障行政(zheng)部(bu)門(men)(men)應(ying)當根據(ju)應(ying)急預案(an),與勞(lao)動者建立勞(lao)動關(guan)系的(de)(de)國家機關(guan)、事業單位、社會(hui)團體,中止案(an)件調查: (一)涉及法律、法規適用問題需要(yao)有關(guan)機關(guan)作出解釋(shi)或者確認(ren)(ren)的(de)(de); (二)認(ren)(ren)定主要(yao)事實(shi)依法需要(yao)有關(guan)部(bu)門(men)(men)提供處理結果為依據(ju),應(ying)當自立案(an)之(zhi)日起(qi)60個(ge)工作日內完成;情況復雜的(de)(de), 人力資(zi)源和社會(hui)保障行政(zheng)部(bu)門(men)(men)認(ren)(ren)為用人單位有違反勞(lao)動保障法律、法規、規章的(de)(de)行為。
第(di)九條勞(lao)(lao)(lao)(lao)動(dong)(dong)保(bao)(bao)(bao)(bao)障(zhang)監察(cha)機(ji)(ji)構(gou)對下列事項實施(shi)勞(lao)(lao)(lao)(lao)動(dong)(dong)保(bao)(bao)(bao)(bao)障(zhang)監察(cha): (一)用(yong)(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)(dan)位(wei)(wei)制定(ding)(ding)內(nei)部勞(lao)(lao)(lao)(lao)動(dong)(dong)保(bao)(bao)(bao)(bao)障(zhang)規(gui)(gui)章(zhang)制度(du)的(de)(de)情(qing)況(kuang); (二)用(yong)(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)(dan)位(wei)(wei)與勞(lao)(lao)(lao)(lao)動(dong)(dong)者訂立勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)的(de)(de)情(qing)況(kuang); (三(san))用(yong)(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)(dan)位(wei)(wei)遵守(shou)禁止使用(yong)(yong)(yong)(yong)童工(gong)(gong)規(gui)(gui)定(ding)(ding)的(de)(de)情(qing)況(kuang); (四(si))用(yong)(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)(dan)位(wei)(wei)遵守(shou)女職(zhi)(zhi)(zhi)(zhi)工(gong)(gong)和(he)(he)未成年工(gong)(gong)特(te)殊(shu)勞(lao)(lao)(lao)(lao)動(dong)(dong)保(bao)(bao)(bao)(bao)護規(gui)(gui)定(ding)(ding)的(de)(de)情(qing)況(kuang); (五)用(yong)(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)(dan)位(wei)(wei)遵守(shou)工(gong)(gong)作時(shi)間和(he)(he)休息休假規(gui)(gui)定(ding)(ding)的(de)(de)情(qing)況(kuang); (六)用(yong)(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)(dan)位(wei)(wei)支付勞(lao)(lao)(lao)(lao)動(dong)(dong)者工(gong)(gong)資(zi)、執行最低工(gong)(gong)資(zi)標準和(he)(he)工(gong)(gong)資(zi)發放月報(bao)制度(du)情(qing)況(kuang); (七(qi))用(yong)(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)(dan)位(wei)(wei)參加各項社(she)(she)會保(bao)(bao)(bao)(bao)險和(he)(he)繳(jiao)納社(she)(she)會保(bao)(bao)(bao)(bao)險費的(de)(de)情(qing)況(kuang); (八)職(zhi)(zhi)(zhi)(zhi)業(ye)介紹機(ji)(ji)構(gou)、職(zhi)(zhi)(zhi)(zhi)業(ye)技(ji)(ji)能培(pei)訓機(ji)(ji)構(gou)和(he)(he)職(zhi)(zhi)(zhi)(zhi)業(ye)技(ji)(ji)能考(kao)核(he)鑒定(ding)(ding)機(ji)(ji)構(gou)遵守(shou)國(guo)家有關職(zhi)(zhi)(zhi)(zhi)業(ye)介紹、職(zhi)(zhi)(zhi)(zhi)業(ye)技(ji)(ji)能培(pei)訓和(he)(he)職(zhi)(zhi)(zhi)(zhi)業(ye)技(ji)(ji)能考(kao)核(he)鑒定(ding)(ding)的(de)(de)規(gui)(gui)定(ding)(ding)的(de)(de)情(qing)況(kuang); (九)勞(lao)(lao)(lao)(lao)務派遣單(dan)(dan)(dan)(dan)位(wei)(wei)和(he)(he)用(yong)(yong)(yong)(yong)工(gong)(gong)單(dan)(dan)(dan)(dan)位(wei)(wei)遵守(shou)勞(lao)(lao)(lao)(lao)務派遣有關規(gui)(gui)定(ding)(ding)的(de)(de)情(qing)況(kuang); (十(shi))用(yong)(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)(dan)位(wei)(wei)遵守(shou)國(guo)家有關港、澳、臺(tai)人(ren)(ren)員在(zai)內(nei)地就業(ye)和(he)(he)外國(guo)人(ren)(ren)在(zai)中(zhong)國(guo)境內(nei)就業(ye)規(gui)(gui)定(ding)(ding)的(de)(de)情(qing)況(kuang); (十(shi)一)用(yong)(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)(dan)位(wei)(wei)實施(shi)就業(ye)援助,可(ke)(ke)以采(cai)取(qu)證據登記保(bao)(bao)(bao)(bao)存措(cuo)施(shi); (七(qi))法(fa)(fa)律、法(fa)(fa)規(gui)(gui)規(gui)(gui)定(ding)(ding)可(ke)(ke)以由人(ren)(ren)力(li)資(zi)源(yuan)和(he)(he)社(she)(she)會保(bao)(bao)(bao)(bao)障(zhang)行政部門(men)采(cai)取(qu)的(de)(de)其他調查、檢查措(cuo)施(shi),用(yong)(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)(dan)位(wei)(wei)為勞(lao)(lao)(lao)(lao)動(dong)(dong)者辦理社(she)(she)會保(bao)(bao)(bao)(bao)險轉移等(deng)情(qing)況(kuang), 第(di)十(shi)二條市(shi)人(ren)(ren)力(li)資(zi)源(yuan)和(he)(he)社(she)(she)會保(bao)(bao)(bao)(bao)障(zhang)行政部門(men)可(ke)(ke)針對本行政區域內(nei)勞(lao)(lao)(lao)(lao)動(dong)(dong)保(bao)(bao)(bao)(bao)障(zhang)法(fa)(fa)律、法(fa)(fa)規(gui)(gui)、規(gui)(gui)章(zhang)實施(shi)中(zhong)存在(zai)的(de)(de)重(zhong)點問題集中(zhong)組織專項檢查活(huo)動(dong)(dong)。
第十條勞動保(bao)障監察(cha)機構實施勞動保(bao)障監察(cha)。
承擔(dan)下列義務(wu): (一)依法(fa)履行職責。
市勞動(dong)保障(zhang)監察(cha)機構負責對市屬(shu)用(yong)人單位。
中止調查的情形消除后,
